Terms and Conditions and Cancellation Rights
Definitions: I/Me/My = The Customer. Vehicle Sourcing, Credit and Leasing Broker = Blue Chilli Car Contracts Limited
1. Blue Chilli Car Contracts Limited is a Vehicle Sourcing, Credit and Leasing Broker and is authorised and regulated by the Financial Conduct Authority. Blue Chilli Car Contracts Limited can introduce to a panel of finance providers who may then pay us for that introduction.
2. I am entering into an Agency Contract (for the Supply of Services) with Blue Chilli Car Contracts Limited.
3. Typically (but not limited to) the services supplied under the Agency Contract by Blue Chilli Car Contracts Limited are; the sourcing of a specific vehicle/s as outlined above, the administration of the financial transaction and the successful completion of delivery of the vehicle(s).
4. The Agency Contract is governed by the Consumer Contracts Regulations, 2014, which allows a period of 14 days from signing above for me to cancel this Agreement.
5. Blue Chilli Car Leasing Contracts Ltd will immediately start to source the vehicle/s under the Agency Contract, which will be during the 14 day cancellation period of the Agency Contract.
6. If a vehicle sourcing fee is applicable, this will become payable immediately upon receipt of an invoice which will be sent to me upon ordering of the vehicle/s. Any amount due is payable immediately to Blue Chilli Car Contracts Ltd, by Bank Direct Payment or cheque.
7. If I subsequently choose to cancel during the 14 day cancellation period I understand I will be liable for a cancellation fee for the Agency Contract as outlined below in condition 10. Alternatively, I agree to pay the Manufacturers Full Retail On The Road Price of the vehicle in order to purchase it. My intention must be noted on my written notice of cancellation. Any notice of cancellation within the 14 day period should be made in writing (email/letter/fax) to my representative. Any amount due is payable immediately upon receipt of a pro forma invoice from Blue Chilli Car Contracts Ltd, by Bank Direct Payment or cheque.
8. The finance purchase/lease contract is a separate Contract between the finance/leasing company and Me. I am aware that once I receive this separate Contract that I will have separate cancellation rights which are fully outlined in the document. Should I wish to cancel this separate Contract, and it is within the cancellation period of the Agency Contract, by default, the Agency Contract will automatically be cancelled and I will be charged for cancellation as per condition 10. below, or I agree to pay the Manufacturers Full Retail On The Road Price of the vehicle sourced in order to purchase it. My intention must be noted in my written notice of cancellation as outlined above in condition 7.
9. Once the cancellation period for the Agency Contract has ended, I have no further rights of cancellation and any request to do so must be at the discretion of Blue Chilli Car Contracts Limited.
10. All cancellation costs referred to above are applicable on the following basis - £750 + VAT reduced for services not yet delivered. This fee will attract VAT at the prevailing rate.
11. I agree to pay any costs incurred by debt collection agents in the course of collection of any of the above or any other sums due.
12. Where Blue Chilli Car Contracts Limited has advised the Customer of any material changes, (such as limited availability to offers by a motor manufacturer, motor dealer or the finance or leasing company), then the Customer will have a right to cancel the Agency Contract without incurring a cancellation fee; except for on rare occasions where vehicles have extended lead times, the vehicle manufacturer will increase the cost of supply of the vehicle. As long as this increase is no more than 10% and there are no more material changes by the Funder, the Customer agrees to pay this increase on rentals or in full, which will be clearly communicated prior to any delivery.
13. Blue Chilli Car Contracts Ltd will make every effort to deliver my/our vehicle/s on time. Sometimes delays occur beyond our control, which means this cannot be guaranteed. Blue Chilli Car Contracts Ltd will not be liable for claims and damages in respect of delayed deliveries.
